From the last three months, has been having lots of queries from the Flat owners, and Paying Guest House owners are on one side and Paying Guests or tenants on another side. All of them are having only one issue that is nationwide lockdown due to the Corona pandemic. The tenants run away to their home towns between 15th March to 21st of March and most of them have not returned till now. Now the issue is that as per tenants they have not stayed at their tenanted premises or PG and this is a very unprecedented event in legal terminology it is called “Force Majeure” so they should not be charged the rent for this lockdown period. The counterparties owners say that they were using the premises because their stuff is still there and there was no “Force Majeure” clause in the agreement signed by both parties. Our politicians like Delhi CM Arvind Kejariwal etc. created more confusion by giving some statements which manipulated by tenants. Here we will discuss, What can be the solution and probable outcome. First What is a force majeure clause?Force majeure clauses are contractual clauses which alter parties' obligations and/or liabilities under a contract when an extraordinary event or circumstance beyond their control prevents one or all of them from fulfilling those obligations.We agree that this lockdown was an unprecedented event but it is doesn’t comes in Force Majeure category as per law because any court in India has declared COVID19 as Force Majeure and in most of the agreements this is not used in India.What is the SolutionThe tenants should either pay his or her dues or request and negotiate with their owners about this loss, and the same time owners should also see tenant's losses and wave off some part of the rent. By doing this they will not loos the client because it will be very difficult to get a new tenant in such time that too at the same rent. (This is our solution but it is not binding on anyone. By the way has agreed to pay rent to all the paid owners of three months in case of default by its tenants.

We at works only on word of mouth. We rely on our owners and tenants for new properties and new tenants. Instead of spending money on advertisements we spend on rewards to those referrers. After working so many years and approaching to lots of HR and Ad-min managers of law firms, MNC's Banks for the services we provide we got very cold treatment from lots of managers even when we provided them testimonials from their own organization. It was a bit surprising. We started to investigate that Why the don't refer us? and for our utter surprise findings was that only politicians or government servants are not corrupt but lots of these managers are "wolfs in sheep's clothing".
Why they don't refer
Actually, most of these managers have a relative, friend who is a broker. They refer his or her name when you ask for housing in Mumbai and that broker does nothing except to call up the agents of those locations where you are looking for a house. By this coordination and sweet talk while showing the places he sets you back by at least one month rent. You being new in the city and under influence of your manager because you can't afford to be in bad books of your HR head agree too. but that is the tip of the iceberg. It is understandable that everyone wants to promote/sell his friend, relative even if he or she might be incompetent. The real story is that lots of these managers have nexus with the brokers and get hefty cut from the commission the broker charges you, from the broker they refer to you. The commission starts from 15% and goes up to 50% in some cases. One thing you have to notice that why brokers who charge such a hefty commission are not doing well because of these big part of their earnings are eaten up by these white collar barbarians. The poor broker does everything from coordination, waiting for you in the scorching heat because you never reach on time and have a handy excuse of traffic. He becomes a punching bag of both the clients because one side is newly graduate thinks that he or she has to concur the corporate world and another side the owner who thinks that he is a lord. It seems that Landlord term came from the owners' attitude.

We at come across the question from our prospective clients that if they don’t find an accommodation or don’t like accommodation arranged by then whether they are entitled to get the refund of Rs. 2000/-?
There are there are lots of things due to deal doesn’t happen and most of these beyond the control of except one that doesn’t offer the good number of options as per benchmark set by it.
If we are not able to offer the good number of options as per benchmarks set by us then you will get the Refund Rs. 2000/- without deducting any single pie. But we won’t be able to provide you a refund because of none of our failure. These are few examples where we were not at fault but opposite party.
1)      Someone relative of IAS officer approached us for Paying Guest Accommodation near Mumbai High Court because he was supposed to intern at High Court. He viewed five options through us and told us that he liked two of them and he would finalize next day. The next day when we got in touch with him when he said that magistrate of High Court offered IAS’s officer’s son his own house to stay. Now if we had not taken our fee beforehand then he wouldn’t be had paid us even though we worked for it and not only met benchmarks set by us but even his expectations.
2)      One guy from *NLU approached us for accommodation for him and one of his friends for an internship. At fixed day and time we arranged viewing accommodations. It was bit surprising for us and while little grilling him we came to know that his friend was the son of directorate general of police of one state and he was trying guest house and they got the news that guest house is fixed.

They charge for electricity, maid even for newspaper, TV Cable, WIFI too even though they don’t spend extra money due to additional users. By the way, they ask very high deposit which becomes a big issue while you are leaving the accommodation. These quoted rents can go UP and DOWN too because all accommodations are different and depend on locations, size of the room, facilities, amenities, furnishing. (All rooms will have basic furnishings like fridge, bed, wardrobe, writing table, chair, and fan etc.)

2) Commuting: - We will arrange an accommodation where you don’t have to take a local train. You will have there options use taxi or bus and there are interns who walk to their workplaces. Average commuting of our clients is 2.25KM.
